What we prepare on a Monegasque trade mark file

A Monegasque trade mark is a national right: first public and notorious use gives ownership, but the exclusive right needs a filing here and a registration (Loi n° 1.058, Art. 3).

Monaco is outside the European Union. The mark sits beside the other files a regulated business opens, the financial licence guide among them; we prepare and steer it.

What is included in the file we prepare

The owner check. Who may hold the mark, and in whose name.

The sign and the classes. Art. 2's grounds; 45 Nice classes.

The prior-art search. The Office's request form, EUR 30.

The filing. In person, or e-dépôt (electronic filing) under conditions.

The irregularity reply. Eight days on form, fifteen on substance.

The certificate and the diary. Collection, gazette annex, renewal date.

Who may own a Monegasque mark, and when to file

A foreign mark does not reach Monaco. Loi n° 1.058, Art. 3 gives the exclusive right only on a Monegasque filing and registration.

A company must be registered first. A legal person absent from the Monegasque company register cannot apply: Company in Monaco: Company Registration in Monaco comes first.

A founder may file personally and assign the mark later.

Foreigners, and collective marks. Art. 13 reaches foreigners established abroad on reciprocity; a collective mark belongs to the State, public bodies and groupings.

How a Monegasque filing runs, from the counter to the certificate

The statute provides no opposition procedure; the route against a registered mark is annulment in court (Art. 30)

2. Clear the sign yourself. The Office does not check availability, and says so.

3. Fix the sign and the classes. Art. 2 bars five kinds of sign; Nice has 45.

4. File. In person for anyone, by e-dépôt under conditions, never by post (the Office's FAQ).

5. Examination. An avis d'irrégularité (notice of irregularity) opens 8 days on form, 15 on substance.

6. The decision. Registration, or a reasoned rejection by the Minister of State, within three months of filing (Art. 6).

7. After registration. The special register, the certificate, publication in the Journal de Monaco annex.

No annual trade-mark fee appears in Arts. 12 to 14: the twenty annual fees there are patents. The Office's site still links a 2024 tariff sheet; the consolidated ordinance controls.

Keeping the mark: renewal, transfers and protection abroad

Ten years from the filing date, renewable without limit (Art. 8).
No reminder is sent: the diary is yours.
Six months of grace after expiry, at half the renewal fee.
Neither sign nor list may be widened on renewal (Art. 9).
Transfers and licences go in writing (Art. 10) and bind third parties only once in the special register, at EUR 35: share transfers in a Monegasque company move no mark.
A mark passes with or without the business, so a business for sale Monaco or Company in Monaco: Ready-Made and Existing Companies in Monaco may leave it behind.
Licensing income is its own head of charge in the profits tax (O.S. n° 3.152, Art. 1er, 1, b)).
No revocation for non-use appears in the statute.

Taking the mark abroad

Component: steps 1. Six months of priority from a first regular filing. 2. Through the Office as office of origin, on a Monegasque mark or application: nationality or domicile for a person, a real and effective industrial or commercial establishment for a company. 3. Wait for the national registration, since a failed basic application takes the international one (the Office says so). 4. Designated offices examine within 12 to 18 months, the mark runs ten years, and Monaco cannot be designated again.

Problems we solve

A sign chosen without clearing it. The Office vets no prior right: an earlier mark, a dénomination sociale (company name), an enseigne (shop sign) or a domain name. A company name is not the mark.

A filing made too early. For a company not yet registered it is inadmissible; filing personally keeps the date.

A renewal missed because nobody was told. No reminder is sent, and the grace period costs half the fee again.

A mark copied in Monaco. Description or seizure by a bailiff on the president's order, proceedings within a fortnight, and the fines of Code pénal, Art. 26.
