How it works

1. You send this form. The activity, the people behind it and the premises are what the Direction du Développement Économique (DDE) examines, so they are what the form asks for first.

2. We read it and reply. The answer comes from [email protected] and names the missing documents, plus any point where the activity as described would need a different company form or its own licence.

3. We open the authorisation file. Each foreign partner and each foreign gérant (manager) applies in their own name (Loi n° 1.144, Arts. 4 and 7), and the rest of company formation in Monaco follows in the order the statute sets.

What we will need from you

What follows the form is documentary and differs by entity. The DDE publishes the application form n° 355-04-05-26, a Note de renseignements individuels for each shareholder and a note on the professional premises (DDE procedure page, French original); the rest depends on the form you choose.

How we handle what you send

The form takes no attachments. What you type reaches [email protected] through our own handler, never a third-party form service, and the address you give is used to answer you and for nothing else. Monaco's Loi n° 1.565 of 3 December 2024 governs that processing, with the GDPR for readers inside the EU. How long an enquiry is kept is set out in the privacy policy.

+ What happens after I submit this form?

It reaches [email protected] through a function on this site. We read the activity against what the Direction du Développement Économique can authorise, then answer by email with the documents the file still needs and with anything in your description that would change the company form or pull in a separate licence. No response time is promised here.

+ Do I have to know the company form before I fill this in?

No. entity_type carries a "not decided yet" option. Capital is one of the things that settles it: EUR 15,000 for an SARL, EUR 8,000 for a SURL whose sole member is a natural person and EUR 15,000 where that member is a company, EUR 150,000 for a SAM (Loi n° 1.573 of 8 April 2025; DDE company-form pages read 2026-09-06).

+ Can the formation be done without my coming to Monaco?

No. Expect to come at least once. Cash capital is released into an account opened for that purpose with a credit institution established in the Principality; a SAM's statutes run through the acte en brevet the DDE procedure page puts before a Monegasque notary; and the premises, which the authorisation names, are part of what is examined.

+ Do I upload my passport or my bank statements here?

No. The form takes no attachments, which is why source_of_funds_ack is an acknowledgement and not an upload. Identity and source-of-funds documents are asked for afterwards, over a secure link, so that no personal document sits on a static host or travels through an inbox it was never meant for.

+ Can you be the manager or the shareholder so that I do not have to be?

No. Lending a name to obtain an authorisation is an offence for both sides, the person who lends it and the person it benefits, punished by a fine of EUR 18,000 to 90,000 (Loi n° 1.144, Art. 15; Code pénal Art. 26). Substitution is also a ground to revoke an authorisation (Art. 9 4°).
